I had heard that if you are illegal you can apply for TPS and during the TPS period, you could find a job that would apply for your green card. But today in conference the USCIS person said you cannot convert TPS to Greencard. Anyone have any information if it's possible to get green card or H1 while you are on TPS even if you were illegal before TPS?

TPS is only work-permit and you can stay here, or go back with AP, and come back. But your illegal status is same throughout the TPS period. Even if you have work-permit from TPS and w/illegal status lets say some business sponsor you, how are you going to do Adjustment of Status later .Unfortunately, TPS is not qualified reason to do Adjustment of Status.. Base on 245(i) of April 30, 2001, you can do Adjustment of Status. BUT if you have approved 245(i) from April 30, 2001, and TPS/EAD combine you can get green card very easily right here in USA within 12-13months. Good luck

anyone who was in the conference and understood clearly what USCIS was saying can answer, don't want just assumption? So what if F-1 status apply TPS and some company files Green Card for him? so F1-TPS-GC, is this allowed? I am assuming, those who are illegal, only for them after TPS ends is not good, since they did not have any status before and after TPS they cannot be adjusted. But, those who holds non-immigrant status currently can come back to same after TPS ends. In the USCIS statement for TPS for Nepal, it is written whenever TPS ends, the current status holders will get back their original status before TPS.

So confusing. So problem solver, those illegals before cannot do adjustment of status after TPS expires? What is the point then? Can u also provide me when is the next USCIS TPS meeting or info session? I have been missing all of them. So no change of status whatsoever? What about thise who were legal and changed to TPS but cannot continue the previous status and are fully TPS?

from TPS -> adjust status (before TPS expires) no problem but not to change status. all experienced lawyers agrees but who are these wanna be lawyers here now says cannot? travelling can be disputed but TPS to adjustment staus has been pretty much settled if you can find sponsor. read previous threads from lawyers.

Controversial, I read the same that adjustment of status can be done before TPS expires, but these guys who are saying can't be done are said to be attending USCIS sessions and USCIS said such things. Not sure, who to believe and who not?

According to one lawyer you can easily go back to non immigrant status during TPS but not immigrant status. However attorney Khagendra Chhetry says TPS can be a step to acquire green card which means can get to immigrant status via job sponsor, gay marriage or traditional marriage to US citizen.

BK01, don't listen to these newbies and uscis officer can only tell what comes after letter A as what is on the paper books but the real person who can manipulate the system is the LAWYERS period hence adjustment is possible GET IT ? . When lawyers signals they can do it (free consultation from lawyers says it) just breath fresh air and don;t listen to these newbies. I highly recommend to hire good lawyer if you are illegal after F1 because there may be big issue if you are travelling though i hope you get the point

UsCIS officer probably says you cannot turn TPS to greencard is because he was probably thinking not graduated F1 people, crossed mexico border people or even B1/B2 who doesn't have proper degree or asylee people . like i said he goes by book a to b rule not how to interpret it . but if you have american bachelor/master degree , overstayed and have sponsor to file GC you can adjust after tps. if you dont know how? a good smart lawyers will do it. for you. in fact tell you the truth people who had stem master degree was able to adjust status just paying some fine even before this tps thing.

Thanks controversial and mangale. That makes so much sense. These new bies are just sharing half knowledge and confusing everyone. A little knowledge is really a dangerous thing. So much evident here. Btw, u also mentioned about changing status before tps by some people. Could u plz share me the lawyer info. I need some good lawyers, just in case for later. Thank you.
