Yes, 5 year is too long to be away from your spouse. I thought INS realized that and made some sort of regulation (or Congress made a law) to have immigrant bring his/her spouse on non-immigrant visa to the US before the spouse becomes eligible for immigrant visa. You may put your question byclicking HERE. May be some other people may have info on this. If you want to throw $75 to $100 per hour to a immigration lawyer, it could be worth it. |

I just found out on V-1 visa. It is for spouse waiting for GC over 3 years. Iit appears you must wait for 3 years after filing petition for your spouse for V-1 visa. you can get more info on this by CLICKING HERE. 3 year is still too long. Try searching on the web. Put your question on different immigration forums. You may get better answer. Or talk to an attorney for $75.00! |

bring your spouse in F1 or instead make them a fiancee so you can get them in K1. the way i know it this is the only way out for now. Or you can wait 5 year. Become a citizen and bring your spouses. |

I think Student Visa (F1) is a good idea. Have your spouse accepted in a school in US (Pilot training/community school where admission is very easy) . Once spouse is in US, you can file petition for GC. The only catch is spouse must be in school fulltime for the next five years to maintain legal status in US and you keep on paying non-resident tuition all those years. Finance Visa (K1) is for fiance of US citizens only! |

my bad K1 for the fiancees of America Citizen. gotcha. may be you do want your spouses to be ready for the job market of US[ assuming that you want a decent paying job] so five years school .. couple of years for Masters or Bachelors and 1 year practical training may not be a bad idea. or you can open your own LLC [ advantage of being permanent resident] and bring your spouses for H1. or can find one of the south-asian body shops to sponsor your spouses for H1-b i am not a lawyer or related to any law firms so I do not know the processes involved in these but these are some of the ways that can be pursued. |
