Hey guys, what happens if someone who is out of status but luckily gets DV lottery; Would he qualify for further apllication procedures such as green card? enlighten me my fellow nepali intelligent brethern....

I think U'll have to go back to Nepal inorder to get it. That's what I hear from people in NY where lots of Nepali have the same problems. Again, I might be wrong...

B4 sending ur e-DV form, put ur corresponding address as of ur home town of Nepal or P.O.Box no( If available). U will be notify first to that add if u win. If u win, U have to go back to nepal for further processing such as interview n visa. Good Luck.

If you are out of status since one year then applying the DV lottery from United States will be hard. There is about 99.9% chances that you might not get it. I am telling this because if you go to US INS website it says specifically that you have to be in STATUS prior to applying from United States. As Status is required because you have to change the status here from whatever status you have to Permanent Resident Status, but if you are not it STATUS then you are in Trouble. So in conclusion, it would be good if you go back to Nepal and apply there to set appointment there-but just make sure that you have a sponser-Very Very Important. And before going to Nepal also make sure that the number u have in the letter is small (e.g 1000-25000). the bigger the number the little the Chances. You really have to make a choice and go for the CHANCE.. BEST OF LUCK...

Even if you did goto Nepal after winning you probalby will not get it. Unless you can convience the consular that your stay in the US was beyong your own control. As I understand anyone who over stays their visa by 1 year is inadmissable back into the US for a period of 10 years. Good Luck However.

Nay Darshankaka, When all the diplomacy and logics run out, then comes such expressions thinking that they still belong to their intelligentsia (oh, that's a hard word for me) group. Ally 74 Congrach!! If the rule did not change since last year, you can still apply for green card if you win the lottery, even though you are out of status. The rule is do not lie to them and you pay fine ( i think about $1k). But best thing is contact lawyer.
