Does anyone can give me information and suggestion about F-1 visa? I am in out of status right now as I didnt extend my 1-20.However I am taking full credits all semesters. My international officer here at my school wants me to file a case for reinstallment. Is it possible for getting in status after being out of status for 8 months? What are the consequences if I dont get reinstallment? Do I have to leave this country immediately? I am enrolling in school as advised by the international advisor.I have one semester to graduate and I am very much worried. Hope someone can help me out who has any idea about out of status and reinstallment or have gone through such experience. Thanks

i think u dont need to extend i-20 as long as taking full courses. somewhere in your i-20 form or in your passport d/s must have been marked by the immigration authority at your port of entry. that grants you to remain in states as long as you are full time student in the designated institution. if there has been new rule, i dont know. check with you int'l student advisor.

.naulo nepali.... check your passport....it says D/S which means you can stay in the US for the Duration of your Study.... BUT ..that won't help you....this D/S should be supported by your I-20 ...which means your I-20 should be valid( not expired)........ there's nly one thing you can do now....either go to the international office in your college and get started in getting new I-20 or just keep quiet for one more semester and graduate.......

I think d/s at port of entry does nt matter as you said you are about to graduate that means you came here in usa about 3-4 yrs ago. last year INS changed all system, and created data base and sarted issuing new SEVIS I -20. if you had nt get that new sevis I 20 then you should talk to your internation advisor, but if you are talkin gabout like your I 20 date is expired and you did nt told your internation office about renewing your I 20 or to get new I 20 then you might be out of status. acording to this new system every internation student should inform about major change, or taking less credits than internationla students are required to take or address change and many other things. so i think you should take help of your internation office and get some written satement from school and apply for reinstallment. good luck.

I think it is re-instate not reinstallment. But either way, If you keep quiet and by the time you graduate, they won't issue you an OPT(optional Practical training). To get OPT, you have to have taken classes as a full-time student. If they find you have taken less than 12 credit hrs. even in one particular semester except for your final semester, your school will not process the OPT application regardless. But again, as long as you are enrolled in school, they won't do anything. The real problem comes when you apply for the H-1 visa becuase you need OPT card for that. Good luck .

Naulo ji Only your international advisor or a good lawyer can give you proper suggestio. Have you international advisor write a reference letter to INS stating that you were full time student during the period and you need to clarify to INS that why you didn't extend your I-20 (did you change major?? took longer than expected to graduate etc..). Your advisor's letter carries more value than anything else. File reinstatement papers quickly, if you get confused hire a good lawyer. Remember you need to have valid I-20 during your OPT/CPT.
