I am an international student with f-1 here in Minnesota. I have some immigration problems and my international student advisor could not provide me satisfying answer and information to me.Thus I am writing to you hope anyone can give me suggestion in this matter. I just realized that my I-20 expired few months back and I went to my International Advisor(DSO) and he told my I fell out of status and have to send forms to INS for reinstatment and cant apply for OPT.As I am graduating this semester. I made all the documents and he also wrote a letter to INS. But however I am very afraid to send those documents to INS as it has been more than 5 months I fell out of status and I was working off campus without INS approval.Even thouhgh I am attending the same college for more than 5 years and always taking full credits and progressing to finish my degree for two majors. I am out of status? Do I have to send reinstament to INS? Will I be deported? What are other possible options like reinstatment or getting new I-20 and reentry to US? Please provide me some informations and advice which will make me very relief Thanks naulo

Naulo bro.. as apc said, dont panic. Apply for reinstate and wait for the result. You should be fine as you have maintained your status. Good Luck.. jaya_nepal

Naulo, I don't want to scare you but this is a serious matter. The so called homeland security can pull all your information especially your work history. I believe working without permission is one of the criteria that satisfies that you are out of status. If that happens in your case, they won't reinstate your status and they give you 180 days to leave the country. I know a similar case that was denied for woking. They provied all the dates and times the person was working for different companies. So, the best thing would be to beg with your advisor if he can do it without sending it to INS. Or see if you can join graduate school. I strongly suggest you to seek more help from knowledgable people. Ask immigration attorney questions for help. Go to immigration.com and read the forum for similar cases to see how they have resolved their cases. BTW, this applies ONLY if you are using your own SSN for the work. You should be fine otherwise.
