Hey anyone know if there is a way for the IRS to know that u r not legal to work but are filing for tax return????? One of my frined is not legal but he works on his ss but wasn;t sure if he could file for tax or will he get into trouble, so thought I might get some tips in here. ANy tips reg this issue is greatly appreciated.

hey alisha,
the IRS will find out. Its risky to work illegally and paying your tax working illegally is like sitting on the end of a branch of a tree and cutting the branch with your own axe. I think your friend should stop doing that immediately. Ask him/her to work on cash payment not payroll otherwise dont work......

In this contry Even prostitutes have to pay taxes (although prostitution is illegal).

Any person, who makes income by doing legal or even illegal work (eg, illegal Immigrant employment, prostitution, illegal gambling) has to pay tax. If the person doesn't pay taxes he/whe will be charged with tax invasion in addition to original charge.

In addition, IRS is very good at privacy protection of taxpayers. IRS doesn't share tax information with any other government agency including INS.

You can get more information about this matter by googling TIN (Tax identification Number). There is a recent article published regarding TIN and INS information.

I'm not sure about the site, so you better go to www.google.com and search for TIN.

Don't worry and pay your taxes. You don't wanna mess up with IRS.

Hey Alishaa,
Your friend should definetely file the tax return. The records are with IRS and if your friend doesn't file he/she may be charged with tax fraud. After that the INS will fiind out and could deport him/her. If they file their taxes than nothing is going to happen. This country has a lot of illegals and its a known fact to the INS. The INS doesn't normally try to haunt you down until you have criminal charges and tax fraud is a criminal charge. So I would recommend them to file taxes.

Hey Alisha,
Currently the INS and IRS systems are not linked, therefore it is highly unlikely that your friend who is working illegally will be caught and face consequences. On the bright side, if your friend ever has or wants to change his residential status in the United States he will be able to establish that he has been paying taxes to support the state and federal revenues, btw that has consequences as well, such as paying a fine for working. And who is your friends employer, whom on the other hand could face a series of prosecution for hiring a employee who is not legally authorized to work in the US. Your friend should try to find employment that pays him cash, and for appearances maybe work somewhere according to his status and pay taxes on that(I hope that awfully long sentence made sense). Regardless I don't think your friend has too much to worry about, the INS have bigger fish to catch for now ;)

Yes , there are ways to figure out who is legal and illegal for work based on your SS#, but this nation does not care for it as of now. They would want you to pay your taxes that is all on that.

Also, illegal people in the restaurant business are encouraged by the government of USA to get tax ID ( I know that coz I work there!). It is like don's ask, don't tell policy.

ps you would be all set as long as you do not get into criminal activities. One in a million gets deported here from USA and he/she could consider himeself/herself to be the most unluckiest one. Of the total popoulation of USA one in every thirty person you see around you is illegal.

I agree with Rauniyar. You can still file for tax return. Out of million and million files of tax return, they don't care if you are illegal or not. All they are concered about is take money or return money until now. However, if you donot file the tax return, they will find out later on when he/she files next time because they have records of your employement history from your past or present employers. So, best decision- have your friend file the tax return.

Some of my friends who are working illegally and paying the tax since 4 years and they are getting the tax return. Nobody care about their status. So, don't worry about that. Your friend can pay tax and file the tax return.
