Hi all Has anybody who has H1B visa, recently been to Canada? Could you please suggest what is necessary? The visa stamp that I got as a student, 5 years back has already expired and I don't have any H1B visa stamp on my passport. However, I am under valid H1B status. My lawyer suggested me to get an appointment in Canada for US visa while I am there. Any suggestions?

No body seems to travel to Canada with H1b, at least people who visit sajha. I had posted similar question couple of weeks ago, nobody bothered to answer. Good luck. If you find any information, please post it here.

Pinky, atleast you replied. I hope Sajha is more than just a 'chautari' to talk about meaningless subject. I have seen it being helpful to some people in getting their answer; hope it applies to us as well. I will let you know when I get an answer.

Pinky Did some reseach, talked to the lawyer. If you don't have a visa stamp in your passport and you just have I-94, that might not be enough. You need to schedule a visa interview at US consulate in Canada for re-entry to US. You need to book the interview right now, goto nvars.com and it will tell you every thing. Hope that helps.

Hi, You might like to check this website: http://www.us-immigration-attorney.com/revalidatingh1b.htm It says: The Visa Office can only revalidate the following types of visas: H, L, O, P, E or I. These visas can only be revalidated if your passport contains a previous visa of the same classification as the visa now being sought. If you do not have an existing visa in your passport of the same category that you seek, you can only obtain a new visa by applying at a U.S. consulate or embassy abroad or through the U.S. border post program. If you are in posession of I-94, from April 1, 2002, it is not enough to reenter US. Thus you have to reapply for a visa. You can either book an appointment for an interview online or by phone. You should also check http://www.isso.cornell.edu/immigration/h1travel.html It says: If you are making a trip outside the United States, to reenter the U.S., you will need the following: 1. valid passport 2. original Form I-797 (H-1 approval notice for your current position) 3. letter from your employer confirming current employment in the position described in the H-1B petition 4. valid H-1B visa stamp in your passport.** If you do not have a valid H-1B visa stamp in your passport, you must apply for one at a U.S. Embassy or Consulate abroad. Also..... Obtaining the Initial H-1B Stamp If you have changed your nonimmigrant status while in the United States and have never had an H-1B visa stamp in your passport, you must make an application with a U.S. Embassy or Consulate the first time you depart the U.S. to obtain an H-1B visa for re-entry.** You will need to present the following documentation: 1. original Form I-797A (H-lB Approval Notice for your current position) 2. copy of Form ETA-9035 Labor Conditions Application (LCA) and Form 1-129 (petition for H1B submitted to INS on your behalf) - these were provided to you by the ISSO when you picked up/were sent your approval paperwork. 3. letter from your department confirming employment and that you are expected to return to the U.S. to resume the terms of your contract 4. original waiver of the two year home residency requirement (if you were previously in J- 1 visa status and received a waiver) 5. valid passport (valid 6 months into the future) 6. Form DS-156 (available at Embassy/Consulate) 7. Please contact the specific U.S. Consulate or Embassy where you plan to apply for other requirements, including photos and fees. Also, note that some Consulates and Embassies have recently changed to an appointment system. Please confirm application procedures prior to your trip. Avi and Pinkey: It is to my interest that I answer most of the visa questions that are posted here at Sajha. But on this one, I had no inputs whatsoever. By that I mean to add that I did read both the post but remained silent. Just that you know. Hope you guys are not going to lose your heart on the validity of Sajha and its "Meaning."
