A Nepali couple on J1/J2 student visa recently gave birth to a child on the US soil. By "The Child Citizenship Act (CCA)", the child becomes a US citizen by birth. I have a query-what happens to the Nepali parents?? Are they legally allowed to work and stay with the child as long as they want?? Do they get any benifit? What about the child?? Do they ultimately become US citizens too?? If so by what time?? The law states that the US born child is a US citizen by birth until the child reaches 18 yrs old when he can decide to choose the citizenship of only one country; either Nepal or USA. Do the parents have to wait for the child to grow up till 18 yrs for them to be legally US citizen through the child?? What about visiting Nepal in between this time?? I am sure there are a number of Nepali couples at this situation. Does anybody out there have some information regarding this?? Please share your experience if you have already been through this situation.
