Hi all,

I have a question on the adjustment of status after DV lottery. Please help me if you have done this before or ifyou know about the process.

I was selected in the Diversity visa lottery 2004 and I got the notification in May 2003. I am in United states since then under student visa. Lately I got a letter from the local Bcis office saying that since i am in their jurisdiction I may be able to submit my adjustment of status in their office. However it did not say anything about whether my vvisa number is available. I am now confused as to whether to file the form I-485 (Application for adjustment of status) with whatever I have or should I wait for further correspendence saying that my visa number is available? Also what is the processing time for this? I heard its really long (like months) and the DV program ends in september. Is it better to try for adjustment of status here in america or should I try to go to Nepal and have interview there (which seems to be faster process)?

The best idea is not to wait. Just go to close by Immigration office, take your day off. They will be able to help you what to do? Waiting won't work. or if you like to find out about visa available at visa center here is the number you can contact. 202-663-1541 and listern carefully. I did not do my own but I work for this kind of job. Wish you good luck. You might need sponsor or if you are making enough money that won't be any problem. One of my friend got Green card within 2 month of submission of I-485. Once you submit I-485 before september, it does not matter whether you get green card before fiscal year for that DV ends or not. They allow you to file I-485 once your DV number appears in visa bulletin. That's what I heard from my that DV winner friend. I might be wrong so better go to nearest
BCIS office to be 100 % sure.

The visa bulletin @ www.travel.state.gov/visa_bulletin.html will tell you if your visa number is current. Your number has to be lower than the number in the bulletin.
I believe you have to file I-539 (adjustment of status). Provided that your visa number is current and papers are in order, the whole process should be pretty smooth. Good luck.
