Work permit, a must for Indians working in Nepal: SC

A Supreme Court decision taken Thursday now requires all Indian workers working in factories and other sectors in Nepal to acquire work permits.

Though the Indian nationals working in Nepal had argued that they need not seek work permit to work in Nepal on the basis of the facilities given by the 1950 Nepal-India Treaty of Peace and Friendship, the court had instructed the government to initiate the necessary steps towards reviewing provisions in the treaty and the Labour Act to issue work permit for Indians.

The instruction had been given in the year 2053 BS. Despite efforts to follow the instructions in 2057 BS, the government had its hands tied after the Indian nationals filed a writ petition at the Supreme Court challenging the recommendations made by the court for the issuance of work permit.

Perhaps on the basis that there is limited National manpwer/workforce in the country that Indians should be hired with work permits!....

What about all the Nepalese working as darbans, bhariya, dishwasher, kulli in India. I came across so many Nepalese working in India when I went to school there. These people from the mountains of Nepal have no other choice but work there and support there poor families. I hope they are not sent back home.

This is a complex issue, not necessarily a good one for Nepal, and I think the
government will probably override this by making some law.

Despite nationalist sounding verdict, it is paagalpan to be provocative to India.
We first need to make our house clean and prosperous, and then lure others
to work here, and then start making these kinds of rules.

We get cheap labourers from Bihar to work on our farms. And this is often two
way process, often mutually beneficial.

In order to protect further terrorism (especially running covertly by Pakis in differents parts of Nepal) and identify Indians from pakistanis, this is the best decision Nepal ever threw after the huge criticism; if you remember ( at the time of Indian plane was hijacked from KTM airport). At that time, Indian government bluntly critisized Nepal's security operations and blamed that Nepal seems like terrorism port in SAARC countries (esps. used by Pakis).
Furthermore, this decision also justifies our Nepali brothers identification to those who live on the border with India because of our other (Nepalis from north don't even consider them as Nepali).

There are more Indians who come to Nepal and get Nepali Citizenships than Nepalese who was born in Nepal.

Those Indians who come to Nepal for work buy citizenship next day if they want to.

This happened to me. One day one Indian citizen (Tibettan Lama) came to Kathmandu and asked me where can he buy citizenship and nepali passport. He was planning to fly to Europe. According to him it's easier to get European visa with Nepali passport than Indian. I don't what that means. I told him that I never heard of it and don't know. We talked little bit more and he left.

After about a week he comes to me with Nepali citizenship and passport. He said he paid Rs. 20,000 and the document was brought to his place.

In my opinion, work permit for Indians is not possible in reality rather it will just make other stuff difficult for Nepal. For example India might implement work permit for Nepal, closing the borders etc.

If we (Nepal Govt. and people) can stand on our own feet, can hold the promise, the corruption is fully controlled, then the situation would be different but for now... it's just another joke.

Let's pray Pashupati nath to give some brain to stupid politicians and beaurocrats.
