Nepal parliament dissolution verdict on Tuesday

KATHMANDU, Aug. 4 ? Nepal's Supreme Court will give its landmark verdict on Tuesday on a clutch of petitions seeking restoration of the Himalayan kingdom's parliament dissolved in May, a court official said on Sunday.

A court approval of dissolution would mean fresh elections set for November 13 in a nation battling an increasingly bloody Maoist insurgency against Hindu constitutional monarchy.
A special bench of 11 judges last month completed hearings on writs filed by over 60 former deputies from ruling and opposition parties who challenged Prime Minister Sher Bahadur Deuba's move to dissolve parliament as unconstitutional and sought its restoration.
''The decision will be taken by a majority of judges,'' Supreme Court spokesman Durga Prasad Dawadi told Reuters.
He said all 11 judges must be present to deliver the judgement. ''If any one failed to turn up the decision could not be given,'' Dawadi said.
Restoration of the 205-member parliament could mean fresh political instability in the country that has seen 11 governments in 12 years, since the ruling party has lost its majority after a split over the dissolution.

Supreme Court dismisses writs

A special 11 member bench of the Supreme Court Tuesday unanimously dismissed four writ petitions challenging the legality of Prime Minister Sher Bahadur Deuba to dissolve parliament and call snap polls from November 13.

Chief Justice Keshav Prasad Upadhaya announced the verdict of the 11-member bench in front of a packed court. Security around the apex court was tight since Tuesday morning for the historic verdict.

The court decision paves the way for the November 13 vote. The verdict is a blow for the faction of the ruling Nepali Congress party led by Girija Prasad Koirala; the faction was hoping the court would invalidate the Deuba decision and reinstate the 205 member House of Representatives.

The UML and RPP, two other political parties represented in the dissolved parliament, said they are prepared for the November polls(nepalnews.com rh/br Aug.6)
