Supreme Court dismisses writs


A special 11 member bench of the Supreme Court Tuesday unanimously dismissed four writ petitions challenging the legality of Prime Minister Sher Bahadur Deuba to dissolve parliament and call snap polls from November 13.



Can somebody give me a brief idea of the supreme court justices and the political influence on them?

The verdict has made it clear that the PM has prerogative to dissolve the parliament in the case that he hails from a party with majority in the parliament and motion of no-confidence is not already registered in the parliament.
To borrow words from Ganesh Raj Sharma: our constitution has conceived a system of stable PM and unstable parliament instead of stable parliament and unstable PM as in the case of Rastriya Panchayat. So, the decision is in accord with our constitution and its gist.

But...there is a bone to pick in the verdict for issue no 5. Essence of the last para is: Although two sessions of parliaments are bound to be within six months, this is valid in cases where the parliament is in existence and does not necessarily hold in all cases. In case when there is parliamnetary election in between, the maximum gap of six months is not mandatory.
This decision gives sufficient ground for a PM to hang on power and turn into a constitutional dictator by postponing the election indefinitely. I smell a rat!

The filing of the case in court was like Fishing Tour, where your

This election will be great indeed. Its core players will be

to get support of Maoists by feeding them money "chanda".
