If Restaurent doesn't help you, move your work to another place and write detail letter about their fruad and undgerground business to INS. or Us government. If you think that they mis-used you for 2 years. Because, most of the Indian, Pakistani, and Bagaladeshi take oppertunity with desprate people from south asian. Restaurent owner must help you somehow or they must give you good wages at least.

thank you so much whoever you are bro...... but the thing really looks bad for me...im illegal here and i can't write to INS or anyone about it.......that's why this moron has been taking full advantage of my desparate situation and i have to do whatever he tells me to......he constantly threatens about reporting me to the INS and he sometimes tells me he won't help me get GC if i try to argue with him and i can do nothing about it...i've come too far to back out, too deep in this mess to get out.....im in a very desparate situation....ppl like me are being taken advantage of in a very cheap way....

You need to explore more about others to find out how they are coping with the situation. Please make your self more available for the social gatherings. Good luck.

Where exactly are you in the process? I mean, have you filed for labor certification, I-140, I-485? There is a new law that permits you to file 140 and 385 at the same time. If you have already filed for 485, after 180 days you can change employer with same job description. if you post the details, it would be easier to give you some advise. good luck.

I meant 485, not 385.

Since the guy knowingly hired you even though you are illegal, his threat are just aimed to discourage/threaten you and frivolous on the basis of law. If you think he's really exploiting you and want to take the law upto him, you might want to consult the labor department (www.dol.gov) or the aclu (www.aclu.org). Recently, there was a court case involving somewhat similar situation, where an employer was sued for exploiting an illegal immigrant. And guess what?? the ruling was on the employee's favour. http://www.rediff.com/us/2002/aug/08fed.htm

hey behaal, u should have maintained ur status, but now it's too late.Anyway, don't let urself to be exploited. These damn indians (boss like urs) is equally responsible and will be punished,if he calls INS and complains, infact it is that man who gave u that job and he will be put in the jail for hiring illegal people. I think even ur boss knows that. That man is simply threntening u.DOn't be disheartened, just consult a lawyer,u'll be charged about $100 or so and move ahead.Either go back to nepal and lead a happy life or find work in other resturants.Just get out.Meet other Neplease and consult them too.By the way, where do u live? Cheer up man and don't be afraid!
