This is a petition to check the bank account and belongings of Girija Prasad Bhattarai and his family. How many think it can be done? Does CIAA have the balls to do it? As long as CIAA does not have the balls to do it, stop whimpering around on small time crooks.

As I had posted in an earlier synonymous topic, who will be regulating the CIAA? How are the appointments being done? Is it done by a politician or thru the merit system. Even if it's done by a politicians, how much discretion do the politicians have to remove him/her? System of checks and balances is pretty inconsistent and ineffective in Nepal. There is no accountability among those who rule not even in the paper. Unless, the CIAA is headed by someone who wouldn't be under the ego-jurisdication of those who hire him/her, I don't see any time in future that a powerful policitian be actively investigated. My fix, set it up as seperate pseudo constitutional body much like the supreme court, headed by a personnel( who will be appointed by the PM, confirmed by the upper or lower house, and leave the king out of this). For now, it might do some work, as to round up some bureaucrats/politicians to the Jail. But effectiveness in the long term under the prevalent system is pretty shallow, I have to be pessimistic.

to know in detail about CIAA,Please visit www.akhtiyar.org.np Features The Commission for the Investigation of Abuse of Authority, known publicly as CIAA, is a top Constitutional Body, which serves as the watchdog against the vice such as the abuse of authority and the resultant chain of corruption existing in the country. The highest law of the land - The Constitution of the Kingdom of Nepal 1990 -provides for it in explicit terms in Part 12, Article 97. The fundamental directive prescribed for it is to probe cases related to abuse of authority by way of corruption, and improper activities by public officials. Various actions including prosecuting the concerned public official in the court of law may be taken by the CIAA. It aims at boosting the cause of good governance in the country through deterring the abuse of authority by public officials. It has a strong belief in nipping the roots of corruption as a means to attain the lofty goal of integrity at the national level. The Commission for Investigation of Abuse of Authority (CIAA) is considered to be the most prominent among public prosecutors in the country. Intellectuals love to refer to it as the Ombudsman of Nepal. However, it embodies both the characters of the Ombudsman and the prosecutor. A person once appointed as the Chief Commissioner or Commissioner of CIAA, according to Article 97 (7), shall not be eligible for appointment in other Government Service. However, nothing in the clause shall be deemed to be a bar to appointment of a Commissioner of the Commission for the Investigation of the Abuse of Authority as its Chief Commissioner, and when a Commissioner is so appointed as the Chief Commissioner, his term of office shall be computed as to include his term as Commissioner. Similarly nothing in the clause shall be a bar to appointment to any position of a political nature, or to any position which has the responsibility of making investigations, inquiries or findings on any subject, or to any position which has the responsibility of submitting advice, opinions or recommendations after carrying out studies or research on any subject. No person, according to the Constitution, shall be eligible to be appointed as the Chief Commissioner or a Commissioner unless he (a) holds a Bachelor's Degree from a university recognized by His Majesty's Government (b) is not a member of any political party immediately before appointment (c) has at least ten years experience in the field of either law, accounting, revenue, construction, development or research, and is a distinguished person (d) has attained the age of forty five The Chief Commissioner or the Commissoner may only be removed from his/her position by way of impeachment through a two-thrid majority at the House of Representatives
