Dhara 127 or Dhara 128

The government of Sher Bahdur Deuba is in crisis. It lost its legitimacy yesterday when it formally announced that the elections have to be postponed for a year. This means, the government headed by Deuba has lost its legitimacy and the King can use either clause 127 or 128 of the constitution of the kingdom of Nepal, 2047 to dissolve this government and either appoint an all party government or a national government.

Dhara 127: badha, adchan fukau prabadhan: Badha Adkau Fukau Prabadhan of the constitution of Nepal has a provision that gives the King constitutional rights to make decisions using his judgment and send it to the parliament for approval.

Let’s analyze whether this clause can be applied to resolve the present crisis:

Yes. This clause can be used. Although the clause clearly states that the King has to get the parliament’s approval to use this clause, there’s no parliament now. This means, the King does not have to get the parliament’s approval. This means, the King can do any thing that he pleases, and that too by abiding with the constitution of Nepal, 2047.

Dhara 128: Sankraman Kaal

More and more people are asking the King to go by this clause to resolve the present political crisis. Dhara 128 gives the King power to appoint either a national government or an all-party government. Going by the constitution of Nepal, the government headed by Deuba lost its rights to govern because it has asked the King to give his approval to extend the elections by a year. When a “antarim” (acting) government fails to fulfill its constitutional obligation, then the government and the constitution both become “niskriya” and the only way out is the use of dhara 128.

What happens if dhara 128 is used:

If dhara 128 is used then the king has to appoint an interim government which can be an all party one or a national one and it will have two major obligations:

· To form a constitution committee to come up with a new constitution. (the government headed by KP Bhattarai from chaitra 2046 to baisakh 2047 is an example of this type of government)

· To hold elections.

One interesting thing to note however is that: that the government formed under dhara 128 can postpone the elections as long as it pleases. It does not have to hold elections in 6 months. This gives the national govt. or an-all party government formed under dhara 128 ample time to resolve the maoist crisis, where as the government formed using dhara 127 has to hold elections in 6 months.

isolated freak is on prozac now. this analysis was done after 2 prozacs that i took with 2 glasses of local tharra. look east, not west:-).. this thought keeps on coming to my brain, don't know why.. maybe i should go shcedule another appointment with Dr. P Bahula soon.

The king should invoke Article 420. What better article than 420 to handle thieves? Let other parties provoke and revoke other stuff.

Restore the damn parliament! why go thru spending millions of rupees and losing many nepali lives to get the same people again in the parliament. The parliament is nothing but a hijada adda anyway...let them(MPs) come back and bark as their central working committees order.

To spare Nepali lives, peace, and money, King should just restore the parliament.

Ek din, chattu le tyo keti lai bhagayecha. When Keti ko aama knew about it, she started crying ... "tori phule gau ko jwai le mero chori laagyo." .. everybody was surprised.. jwai le chori nalage kosle lagcha.. ani tori every gau ma phulcha... Everybody declared her as an insane .... re...\
