hello. i was living in usa for out of status a year on student visa, actually the visa was still valid, i just did not attend college classes, b.c of financial problems. a month ago i got a new I 20 from university, and left usa and for a new visa, the embassy gave me a 5 year visa ! i only have one semester of classes left to take! kina testo? so therefore i can now come back to usa legally. however, i got arranged while home, and now i am going to get married when i go back to usa asap, the boy is american citizen.
i am worried because i worked illegally for six months, i gave real social security number to my workplace, even though i did not have work permit. my work does not know yet that i am working illegal, it is a small organization and they dont check, now i even got a raise, so i feel guilty, ke garni? is this going to affect my application for green card?
another thing , once i enter as student, then get married , how long does it take for me to get greencard? does my status change immediately, like conditional green card holder?
since i have 5 year visa already in my passport will they not be willing to change my status? i need to work and also would like benefits like cheap in state tuition. someone told me that i can get all benefits immediately after marriage, even though i dont have greencard in hand is that true? any other advice or suggestions? main thing is illegal working, i checked the ins site and it says that one is ineligible to apply if they illegally worked in the usa, unless they are spouse of children of usa citizen, but what if they worked illegally before marriage , does that count?please let me know.

The fact that you worked illegaly before you got married to an American citizen should not jeapordize your eligibility for a green card. It might mean that INS will look into your case with a higher degree of suspicion. However, if your marriage is real, then you have nothing to worry about.

I think the process on how long it takes to get a conditional green card (you first get a temporary stamp on your passport identifying that you are conditional green card holder) is about 3 months. However, this depends on where you are in the country. INS has regional offices and they all have different number of cases they are working and therefore have different waiting periods.
