i entered US on student F1 visa and did unauthorize employment for 2 years using my SSN and filed Tax returns. Later got OPT and H1 work visa. Now i am on H1 and about to file employment base status adjustment ( EB2 i-485 ) for green card process. LAW SAYS: "An alien who failed to maintain, continuously, a lawful status and/or engaged in unauthorized employment for more than 180 days since their last entry is not eligible to apply for employment based Green Card adjustment of status (EB i485)" This law applies to employment based GC applicants only and NOT MARRAIAGE OR ASYLUM based GC applicants. One solution to this problem is to go abroad and re-enter US on any valid visa (e.g, h1b stamping) to reset the 180 day count. Since days are counted from your last lawful entry in US for GC work based adjustment purpose. Since law counts DAYS from your LAST LAWFUL ENTRY TO US, thats how F1 students with illegal jobs reset their 180 day count and become eligible to file GC. Since my last entry i have unauthorized work of more than 180 days. MY QUESTION Anyone you know in same situation got employment based GC approval without leaving US with 180+ days illegal work since last US entry? any experienced suggestions are also welcomed.
