My h1b amendment (Location change) is filed by my current Employer A and it is still in pending status for 90 days or so. I want to transfer to Employer B (premium processing) however the client/location/project is same. In the current situation, is it a good idea to go ahead with transfer? Has anyone been in similar situation recently? What happens if H1b transfer gets denied? Please, provide suggestions if anyone has any experience/suggestions. Thank you... Your employer B petition will be net new, as there is no such thing as a H1b transfer. You are allowed to file as many petitions as you want, provided Employer B satisfies all criteria.

I would not recommend doing H1 transfer until your amendment is finalized. You certainly can do H1 transfer but if your transfer is denied somehow you will also lose the validity period of your h1. If your amendment is denied you would still retain your old validity. In such cases, you can start the h1b transfer.
