Hello,

I have some questions regarding the immigration petition and if it impacts current tourist visa. I have been thinking about getting an immigration petition( Form I-130 ) for my parents started through my aunty who is a US Citizen. With the upcoming RAISE act, we are thinking if we should just get it started now. But my parents are worried if their current tourist visa will be cancelled or when times comes for their visa renewal, an immigration petition will impact the renewal in any case. My parents have renewed their visa for 3 times already so just don't want to loose that privilege due to the immigration petition. Any thoughts out there regarding this issue?

Any advices must appreciated! Thank you!

If i am not mistaken you're tying to get GC for your parents thru your Aunt which is the category F4 of Brother/Sister of the US Citizen. You know how long it takes. National Visa Center (NVC) is processing the date of 22 JUL 2004 on F4 category now which is almost 14 years behind. so you can calculate if you start now then when the visa will available for you parents. the current tourist visa status and visa cancellation won't effect the immigration visa process.

Tutepani, I don't see the category to sponsor for parents in the list. What about that category? Anyone have any idea?

Sunile,
The parents don't need to wait for visa availability in NVC, they are immediate family. NVC starts the process Once they get a case from the USCIS ( approx 6 months for USCIS process). The US citizen parents get interview schedule at the local embassy within a year. The GC holder can't apply for the parents , only for US citizen.

Parents are fall under IR5 category and like tutepani said they don't need to wait for visa availability
